400-15 MOWING ROAD ALLOWANCES

STATEMENT:

Council recognizes the value of hay and grass growing on municipal road right of ways, and where possible, will permit, with conditions, the mowing of road allowances for hay salvage.

POLICY:

  1. Where favourable conditions exist, hay/grass may be salvaged (cut and baled) on municipal road right of way prior to July 8 in any year by the adjacent landowner, lessee, or their designate.

  2. Non-adjacent landowners or lessees who wish to harvest roadside hay/grass prior to July 8 are to contact the adjacent landowner or lessee and make arrangements to become their designate.

  3. After July 8, of each year, any person may salvage hay without the permission of the adjacent landowner or lessee, provided the adjacent landowner or lessee has not begun salvage operations.

  4. The right of way must be left in a neat appearance by the person salvaging the hay.

  5. Bales of hay/grass weighing 100 kilograms or greater must be situated at least two (2) meters from the shoulder of the roadway.

  6. All bales must be removed from the municipal road right-of-way on or prior to August 8 in any year

  7. The Council reserves the privilege and right for its members, employees and/or agents/contractors to enter upon said right of way for the maintenance and/or reconstruction of said roadway or for other purposes as may be deemed necessary, and at no compensation or reimbursement to the party salvaging the hay therefrom.

  8. Mowing on municipal right of way may take place by Council prior to July 8 for any reason,or as required for the control of noxious weeds, safety and aesthetic reasons or in order to secure a contractor to perform the work.

  9. The Municipality assumes no liability for labourers, machinery or bales relating to the salvage of hay operations.

  10. Council reserves the right to revoke this policy without notice to any person or persons who have participated in any similar program offered in the Municipality in the past.

Conflict, Investigation and Resolution:

Should council be informed of non-compliance with this policy, either through written, verbal, or visual confirmation by councillors, staff or ratepayers; then council as a whole will be responsible to ascertain what action, if any is required and may include, but not exclusive to the following:

  • In order to minimize hazards to motorists, any bales not meeting the requirements stipulated in parts 5 and 6 above may be removed by the municipality and any bales so removed shall become the property of the municipality or the bales may be destroyed by the municipality.

  • It is the responsibility of anyone mowing municipal right of way to follow safe operating procedures when mowing or salvaging hay. The individual mowing the right of way for salvage will be liable for any damages they case to Municipal or private property, such as, ditches, culverts or culvert markers, signs, utilities, etc.
